The Consultation

The government is currently reviewing the BBC’s system of funding a view to possibly decriminalising TV licence evasion.

The first interesting statement in the document on the first page reads as below:-

The Government believes that it is right to look again at whether the criminal sanction remains appropriate for TV licence fee evasion given ongoing concerns that the criminal sanction is unfair and disproportionate.

The decision as to what, if any, action is to be taken hinges on the factors stated below in the consultation document:-

In deciding whether to decriminalise TV licence evasion and considering how this could happen, the Government’s objectives and determining factors will include:

  • whether an alternative, non-criminal enforcement scheme is fairer and more proportionate;
  • the cost and difficulty to implement any alternative scheme;
  • the potential impact on licence fee payers, particularly the most vulnerable and those with protected characteristics; and
  • the overall impact on licence fee collection.
